These terms are an agreement between you and the operators of Winston ("we", "us") covering your use of the Winston desktop application and the services behind it. By creating an account or using Winston, you agree to them. If you do not agree, do not use Winston.
Winston is early software, offered free of charge while in beta. It will have bugs. Features may change, break, or be removed. We may update, suspend, or discontinue the service at any time. Because Winston stores its data on your own Mac, keep your own backups of anything you cannot afford to lose; beta software is not a system of record.
You own your data. Your email, calendar, documents, and everything Winston derives from them belong to you and live on your Mac. We claim no rights over them. Our privacy policy at mywinstonhq.com/privacy describes exactly what is transmitted and what we store; it is part of these terms.
Connecting a Google account is optional and yours to control. You grant Winston the permissions shown on Google's consent screen, and you can revoke them at any time, either inside Winston or at myaccount.google.com/permissions. Winston does not send email on your behalf: drafts are written inside Winston and you send them yourself from your own mail client.
Winston uses AI models to read, summarize, and plan. AI output can be inaccurate, incomplete, or out of date, and Winston can misread a deadline, a name, or an obligation. Winston shows you the evidence behind what he claims so you can check it, and asks before taking actions that matter. You remain responsible for your own decisions, deadlines, and communications. Do not rely on Winston as your only record of anything important, and do not treat his output as professional, legal, medical, or financial advice.

Beta access is by invitation and per person. You are responsible for the security of your own Mac and Google account. We may suspend or terminate accounts that violate these terms or that we reasonably believe are being used abusively.
Winston is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that Winston will be uninterrupted, error-free, or that it will catch every commitment in your mail.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or missed obligations, arising from your use of Winston. To the extent any liability is not excludable, our total liability for all claims is limited to the greater of fifty US dollars or the amount you paid us for Winston in the twelve months before the claim (which, during the free beta, is zero).
You can stop using Winston at any time. Disconnecting Google and deleting the app and its data folder removes Winston from your life; the privacy policy describes how. We may terminate or suspend the service or your access to it, with notice where practical. Sections 2, 4, 7, 8, and 10 survive termination.
These terms are governed by the laws of Delaware, without regard to its conflict-of-law rules. Disputes will be resolved in the courts of Delaware.
We may update these terms as Winston evolves. We will update the effective date above, and for significant changes we will tell you in the app before they take effect. Continuing to use Winston after a change means you accept the updated terms.
